Mother sues doctor over twin birth


A woman has told the ACT Supreme Court she felt trapped when she found out she had conceived twins through the IVF program because she only wanted one child.

The former Canberra woman and her female partner are suing Doctor Sydney Robert Armellian for the wrongful birth of one of their twin girls.

They are claiming more than $400,000 for the cost of raising one of their children.

Today the 40-year-old mother told the court she had had many discussions with Dr Armellian about wanting a single pregnancy.

An embryologist under his supervision implanted two embryos, resulting in the birth of non-identical twins.

The woman told the court, while in the procedure room she was never asked how many embryos were going to be implanted and the embryologist did not approach her to check.

The case continues.




Personally, I think she's a thankless cow but that's just me.

  • Umm, lady, way to do your research on a procedure before having it done. It's usual practice to implant more than one embryo at a time because there's a higher likelihood that one will "take" that way. The practice isn't foolproof. I've heard that sometimes four embryos will be implanted and only one will take, or none of them for that matter, and other cases where all four babies go full term. *I* know that and I am lousy at biology, as well as being completely and totally disinterested in the idea of having children anytime soon.

    I feel terrible for the girls though, I mean one of them is a mistake, right? So now they have to go through their lives wondering which one wouldn't have made it, or probably completely resenting their parents. I hope that these women who only wanted the one baby love both of these little girls.

    EDIT: I just told my friend Colleen about this, and she was thoroughly disgusted by the woman. Then I said that it happened in Australia and she said "Maybe the Dingo should eat her baby." And I haven't stopped laughing.
  • Ya, that really stinks. I mean, how do you tell your daughter, "Well, I had this big lawsuit against my doctor because I didn't want you." It's bad for both the girls because, like you said, they will go through life wondering which one wasn't wanted.

  • Why'd they go IVF anyway? Were they having trouble conceiving? They're lucky to have a child at all!

    Ya know when you do it the old fashioned way you take your chances that you're only going to have one kid. Most of the time that's what happens, but if you happen to have twins the husband doesn't get to sue the wife for wrongful birth!!

    and either way... how horribly selfish... i agree with everything rachel said. the whole point in implanting more than one embryo is for the odds of conceiving to go up... it's not like her doctor intentionally got her pregnant with twins... what a bitch. mad.gif i feel bad for her girls the most.

    There's your answer. Biological impossibility for them to have conceived "the old fashioned way". It's just so sad - those poor babies.

    A woman has told the ACT Supreme Court that her female partner felt violated and extremely angry when she found out she would be having twins through the IVF program, rather than just one child.

    The 39-year-old woman and her female partner are suing Dr Sydney Robert Armellin for the wrongful birth of one of their twin girls.

    They want $400,000 in compensation for the cost of raising one of them.

    Today the former Canberra woman told the court the couple signed a document that stated her partner would have one to two embryos implanted.

    She said no changes were made to the form before the operation went ahead.

    She said when they found out they were having twins, her partner who was carrying them, said she felt desperate and wished that one embryo would just go away.




    Those poor little girls. You know they're going to hear about this as they get older. Their mother felt "Violated" by their existance? Good God, woman. Clearly they knew they'd have one to two embyros implanted, it says right there they signed the fucking form.

    I'm pro-choice and all of that, but these women ASKED for a baby - they have no business in court.

    Agreed. You don't ask for a blessing and then throw a hissy fit when you get that blessing and then some. I mean, did they really that desperately want to be parents? Their attitude towards it is just so despicable. I know people who actually needed to use IVF to conceive and they would have been fucking overjoyed just at the idea that they managed to conceive. They wouldn't shit all over the fact they managed to have two when they otherwise wouldn't have had any.

    They strike me as the kind of people who want children for selfish reasons, not because they truly love children and want to be great parents. Like, "Oh hey, let's have a mini you, that'd be cute. We could dress it up just like a real life barbie". That kind of idea of parenthood, you know?

    Two embryos were implanted into the woman carrying the child, instead of one.

    Today, Dr Armenllin's lawyer Kim Burke told the ACT Supreme Court because the woman was under general anaesthetic the embryologist did not double check how many embryos should be inserted, which would have been normal procedure.

    She said because the plaintiff had indicated on a signed form that she wanted up to two embryos implanted, two were transferred.

    The case continues.

    I don't see how there even is a case given this. She got exactly what she signed up for even if it wasn't what she wanted.
